Overview of Event Photography Agreement

What is this document?

An Event Photography Agreement is an agreement used between a photographer (or photography company and their photographers) and the client who has hired them to take photos.

When would I use this document?

This agreement can be used when the photographer and the client want to ensure they have agreed about who owns the intellectual property in the photographs, how the photographers will be compensated, how the client will obtain access to the photos, and whether the photos can be sold to others or displayed on the internet without the client’s consent.

Who signs this document?

This agreement is signed by the client and the photographer (or an individual who can bind the photography company).

Clients who are photographed have an interest in deciding how the photographs will be used by the photographer, and how to protect their privacy. The photographer has an interest in being able to build a portfolio for display to attract other clients, and possibly to sell photographs to persons other than the client.

Both the client and the photographer will want to ensure that the following matters are clear: who owns the intellectual property associated with the pictures, whether the pictures can be made public, the payment terms, whether the photographer will require meals or other physical accommodations, and what happens if there is a cancellation. Setting out these terms can be important in avoiding disputes in the future.
